Official Rules & Privacy Policy : Terms & Conditions: Fat Free Fiancee: ELIGIBILITY REQUIREMENTS / TERMS & CONDITIONS All applicants must acknowledging that they have read, understand and will comply with all of the following eligibility requirements ("Eligibility") of the television show presently entitled “Back in Black” (collectively the "Program") in order to proceed with the application process: 1. Employees, officers, directors and agents of (or those who have been in the past six (6) months employees, officers, directors and agents of) The Jay and Tony Show, Inc. ("Producer"), and all other companies associated with the production, administration and/or exhibition of the Program and/or any of their respective licensees, assigns, parents, affiliated and subsidiary companies, divisions, and joint ventures as well as (a) the immediate family (spouse, ex-spouse, mother, father, sister, brother, daughter or son, step-parents, step-children, step-siblings, regardless of where they live), and (b) members of the same households (whether related or not) of such employees, officers, directors and agents; are not eligible to participate in this application process. In addition, any applicant closely acquainted with any person connected with the production or administration or exhibition of the Program is not eligible if, in Producer's sole discretion, the person's participation could create the appearance of impropriety. 2. Applicants may not presently be a candidate for any type of political office ("Candidate") and may not become a Candidate from the time the application is submitted until one (1) year after first broadcast of the last episode of the Program in which they appear. 3. All applicants must be United States legal US residents. 5. All applicants must be at least twenty-one (18) years of age at the time of application. 6. All applicants must be legally residents of the United States. 7. Applicants must never have had restraining order entered against them, either of which were based in whole or in part on the commission of one or more acts involving moral turpitude or violence, as defined by the Producer in its sole discretion. 8. All applicants understand and acknowledge that participation in the Program, including, without limitation, the activities and events arranged by the Program coordinator, may expose applicant and other participants to the risk of death, serious injury, illness or disease and/or property damage. Applicants must be willing and able to participate in physical activities. Applicants understand that by submitting this participant application (the "Participant Application"), applicants acknowledge that they accept and assume all risks known or unknown of any nature (including, without limitation, the foregoing) that may arise in any way from or relate to applicant's participation in the selection process for and/or, if selected, participation in the Program. Applicants acknowledge that if selected to participate in the Program, he/she will be required to sign additional releases attesting to the fact that the applicant understands and knowingly and willingly agrees to assume such risks. 9. Each applicant acknowledges, understands and agrees that Producer may disclose any information contained within or derived from his or her application to third persons connected with the Program and to compile information from third parties in connection with such application and the application process about applicant's private, personal and public life, personal relationships with third persons, confidences and secrets with family, friends, significant others, including without limitation: physical appearance; personal characteristics/habits (both physical and mental); medical treatment/history (both physical and mental); sexual history; educational and employment history; military history; criminal investigations, charges and records; personal views and opinions about life, the world, politics, religion, and the like (collectively, "Personal Information"). Applicant acknowledges and agrees that Producer may reveal such Personal Information to third parties in the course of the application process and/or on the Program and that Applicant releases, discharges, and holds harmless Companies (as defined below) from any and all claims and damages arising from such compilation or disclosure of Personal Information. 10. Each applicant acknowledges, understands and agrees that he or she, if chosen for the Program, may be audio and/or video taped twenty-four (24) hours a day, seven (7) days a week while participating in the Program by means of open and hidden cameras, whether or not he or she is then aware that he or she is being videotaped or recorded (collectively, "Recordings") and that such Recordings may be disseminated on television and/or all media now known or hereafter devised, in any and all manner throughout the universe in perpetuity. 11. Applicants acknowledge, understand, and agree that Companies (as defined below) use or revelation of Personal Information and Recordings as defined in these Eligibility Requirements may be embarrassing, unfavorable, humiliating, and/or derogatory and/or may portray him or her in a false light. Each applicant agrees to release, discharge and hold harmless the Companies from any and all claims (including, without limitation, claims for slander, libel, defamation, violation of rights of privacy, publicity, personality, and/or civil rights, depiction in a false light, intentional or negligent infliction of emotional distress, copyright infringement, and/or any other tort and/or damages arising from or in any way relating to the submission of a Participant Application, participation in the selection process, participation in the Program, the use of the Personal Information or Recordings and/or the use of the applicant's name, voice, and/or likeness in connection with the Program, or the promotion thereof in all media now known or hereafter devised. Applicants are required to sign Releases to this effect. "Companies" as used herein shall collectively mean AND Syndicated Productions, Inc., The Jay and Tony Show, Inc., American Broadcasting Companies, Inc., and all other subsidiaries and divisions of The Walt Disney Company, Warner Horizon Television, Inc., and all other subsidiaries and divisions of Warner Bros. Entertainment Inc., Time Warner Inc., all advertising, promotional and judging agencies, Program broadcaster and distributors and all other companies associated with the production, administration and/or exhibition of the Program and/or any of their respective licensees, assigns, parents, affiliated and subsidiary companies, divisions and joint venture partners, and each of their respective employees, officers, directors and agents. 12. Each applicant acknowledges and agrees that he or she is not and will under no circumstances become an employee or an independent contractor of the Producer and/or Companies as a result of the submission of a Participant Application, participation in the selection process, participation in the Program, the use of the Personal Information or Recordings and/or the use of the applicant's name, voice, and/or likeness in connection with the Program, the promotion thereof in all media now known or hereafter devised or for any other reason in connection with his or her application and/or participation in the Program, and each applicant further acknowledges and agrees that he or she will not make any claims against Producer and/or Companies, including, without limitation, claims for compensation, derived from any allegation of status as an employee. Each applicant acknowledges and agrees that his or her relationship to Producer and/or Companies is and shall be limited solely to that of a grantor of rights and/or Program participant. 13. Any applicant who has appeared on any primetime television reality show such as, without limitation, "Survivor," "Big Brother," " The Apprentice," "Joe Millionaire," "Elimidate," "Amazing Race," "Fear Factor," "American Idol," "Extreme Makeover," "Blind Date," etc, or is involved in the current production of any such television show (or has been involved in a past production of any such television show that has not yet aired) must disclose such information in his or her application and may, at Producer's sole discretion, be deemed ineligible to participate in the Program. If any applicant is currently being considered as a contestant and/or participant in a primetime television reality/game show, he/she must withdraw his/her application from such competing show upon Producer's request. 14. All applicants must authorize Producer to conduct a background check, which may include, without limitation, a credit check, a military records check, a criminal arrest and/or conviction check, a civil litigation check, a family court litigation check, interviews with employers, neighbors, teachers, etc. All applicants must sign the attached Authorization to Release Personal and Confidential Records and Information. 15. All applicants who are selected as Semi-Finalists to be on the Program must be available to travel to Los Angeles for further interviews. (Location and date to be determined and are subject to change in Producer's sole discretion). 16. All applicants who are selected as Semi-Finalists must complete and timely return the "Semi-Finalist Package," which may include, among other documents: a Medical History Form and Authorization (which form should be completed by Applicant and his or her own physician at Semi-Finalist's own expense); General Release and Indemnity Agreement; Confidentiality Agreement; and Background Check Authorization Form (all forms will be furnished to the Semi-Finalists). In the Authorization, General Release and Indemnity Agreement, the Semi-Finalist agrees to assume the risk of any and all injury, illness, damage, loss, or harm to Semi-Finalist's person or property of any kind, howsoever caused, arising from or relating to the submission of a Participant Application, the selection of Semi-Finalist, and/or participation in the Program, and/or the production and/or exploitation of the Program. 17. All applicants who are selected as Semi-Finalists and to travel to Los Angeles may be required to undergo physical and psychological examinations and testing (to be conducted in Los Angeles by qualified personnel selected by the Producer) and meet all physical and psychological requirements, as set by Producer in its sole discretion. 18. Semi-Finalists shall treat all information and materials received or acquired about Producer, Companies, the selection process and/or the Program, as strictly confidential and shall not disclose or otherwise disseminate any such information to any third party. Semi-Finalists must sign a Confidentiality Agreement in the form presented by Producer. 19. Upon Producer's request, all applicants selected for the opportunity to participate in the Program must agree to sign and return to Producer a Program participant package which will include, without limitation, a General Release and Indemnity Agreement, Confidentiality Agreement, Background Check Authorization Form, and any additional releases or authorizations that Producer, in its sole discretion, deems necessary. 20. Applicants must be available to travel and participate in the Program for selected consecutive days over approximately a four to five week period during production, and to participate in taping additional Program materials and in promotional activities for the Program for selected days thereafter upon Producer's request. Applicants must agree to live, participate and cooperate with the other individuals and the Producer during the taping of the Program. Applicants must be able to travel for long periods of time, must be adaptable to various living situations, and must enjoy participating and living in close proximity with others of varied background and experience. 22. Applicants must report and be available to participate in the Program at all times and places as Producer shall designate. 23. Applicants understand and agree that the Eligibility Requirements may be changed, modified, or amended by Producer in its sole discretion from time to time. © 2007 The Jay and Tony Show, Inc. *By submitting this Application online, Applicant understands and agrees to the following: 1. I acknowledge and further agree that Producer has the perpetual, irrevocable and unencumbered right (but not the obligation) to use, distribute and exhibit (and/or to authorize others to use, distribute and exhibit) all or part of the Rights and Materials in any and all media now known or hereafter discovered, in perpetuity, throughout the world, including without limitation, in and in connection with segments of the television program currently known by its working title “Here Come the Newlyweds” (or any version thereof) (the "Program") or in any other program, (and in connection with all ancillary, incidental and subsidiary rights related thereto ), and in television, radio, and other advertisements and promotions for the Program (the "Advertisements") and other programs; and to edit the Rights and Materials, and the Program as Producer wishes. I also understand and agree that Producer may assign this agreement in whole or part and the rights granted herein shall inure to the benefit of Producer, its licensees, successors, and agents. 2. Release: I WILL NEVER SUE PRODUCER, OR ANYONE 1) BECAUSE PRODUCER, ITS LICENSEES, SUCCESSORS AND ASSIGNS DID NOT TAKE OR USE THE RIGHTS AND MATERIALS GIVEN BY ME; OR 2) BECAUSE I DO NOT LIKE THE MANNER IN WHICH THEY TOOK OR USED THE RIGHTS AND MATERIALS GIVEN BY ME; OR 3) IN CONNECTION WITH ANY CLAIM RELATED TO MY APPLICATION FOR, PARTICIPATION IN OR EXHIBITION OR OTHER EXPLOITATION OF THE PROGRAM. I UNDERSTAND AND AGREE THAT THE PROGRAM MAY INVOLVE THE ELEMENT OF SURPRISE. Use of Rights/No Revocation: I understand that AND is not obligated to use any of the Rights and Materials granted herein. Confidentiality: I acknowledge that in the course of my participation in the Program, I may gain access to confidential information, trade secrets, records, data, and other information (hereinafter collectively the “Information”) relating to the Program (including, without limitation, the identities of the participants and/or the outcome or content of any episode). I understand and agree that all such Information is and shall remain the property of Producer and/or its related or affiliated entities. I further agree that unless and until Producer discloses such Information to the general public, I shall not, without the prior written consent of Producer, disclose, or cause to be disclosed, any such Information to any third party or entity, for any reason or purpose whatsoever. I understand and acknowledge that I shall be held fully responsible for all costs and damages incurred by Producer which result from my breach of my confidentiality obligations, and that such costs may include the costs of production. 6. Other: Producer shall exclusively own the copyright in and to the Rights and Materials and any use and/or recordings made utilizing the Rights and Materials and Producer has complete and sole discretion as to their use. I represent and warrant that I have the full right, power and authority to grant the rights herein granted. Under penalties of perjury I certify that the information, materials and representations given or made by me which are contained on this form are true and correct. This Release shall be performed at least in part in California whose law shall govern and whose courts located in Los Angeles, California shall have exclusive jurisdiction over any dispute relating to this Release. In any such dispute, I hereby waive all rights to claim punitive, incidental and consequential damages. 7. All applicants who are selected as Semi-Finalists and to travel to Los Angeles may be required to undergo physical and psychological examinations and testing (to be conducted in Los Angeles by qualified personnel selected by the Producer) and meet all physical and psychological requirements, as set by Producer in its sole discretion. 18. Semi-Finalists shall treat all information and materials received or acquired about Producer, Companies, the selection process and/or the Program, as strictly confidential and shall not disclose or otherwise disseminate any such information to any third party. Semi-Finalists must sign a Confidentiality Agreement in the form presented by Producer. 19. Applicants must report and be available to participate in the Program at all times and places as Producer shall designate. 23. Applicants understand and agree that the Eligibility Requirements may be changed, modified, or amended by Producer in its sole discretion from time to time. © 2007 The Jay and Tony Show, Inc. *By submitting this Application online, Applicant understands and agrees to the following: 1. Grant of Rights: For good and valuable consideration, receipt and sufficiency of which is hereby acknowledged, I irrevocably grant to Producer, The Jay & Tony Show, and all other companies associated with the production, administration and exhibition of the Program, advertising, promotion and public relations agencies related to the Program and each of their respective partners, parent companies, operating divisions, subsidiaries, affiliates, related companies and assigns, joint ventures, licensees and their respective officers, directors, employees, representatives and agencies (collectively and individually, for the purpose of this Grant of Rights, "Producer"), the following rights (hereinafter "Rights and Materials"): to interview me (on and off-camera), to record on film, tape or otherwise use the following: my name, likeness, image and/or voice; my on and off camera interview(s), story(ies), activities and performance(s) (hereinafter “Taped Activities”); and other material or information provided by me (including, but not limited to, any video, stills, depictions and/or applications or other materials submitted by me); my biographical material; and my surroundings (to the extent such occurs in my home or a place of which I have possession). I hereby represent and warrant that I am the sole copyright owner of all such Rights and Materials. I acknowledge and further agree that Producer has the perpetual, irrevocable and unencumbered right (but not the obligation) to use, distribute and exhibit (and/or to authorize others to use, distribute and exhibit) all or part of the Rights and Materials in any and all media now known or hereafter discovered, in perpetuity, throughout the world, including without limitation, in and in connection with segments of the television program currently known by its working title “Here Come the Newlyweds” (or any version thereof) (the "Program") or in any other program, (and in connection with all ancillary, incidental and subsidiary rights related thereto ), and in television, radio, and other advertisements and promotions for the Program (the "Advertisements") and other programs; and to edit the Rights and Materials, and the Program as Producer wishes. I also understand and agree that Producer may assign this agreement in whole or part and the rights granted herein shall inure to the benefit of Producer, its licensees, successors, and agents. 2. Release: I WILL NEVER SUE PRODUCER, OR ANYONE 1) BECAUSE PRODUCER, ITS LICENSEES, SUCCESSORS AND ASSIGNS DID NOT TAKE OR USE THE RIGHTS AND MATERIALS GIVEN BY ME; OR 2) BECAUSE I DO NOT LIKE THE MANNER IN WHICH THEY TOOK OR USED THE RIGHTS AND MATERIALS GIVEN BY ME; OR 3) IN CONNECTION WITH ANY CLAIM RELATED TO MY APPLICATION FOR, PARTICIPATION IN OR EXHIBITION OR OTHER EXPLOITATION OF THE PROGRAM. I UNDERSTAND AND AGREE THAT THE PROGRAM MAY INVOLVE THE ELEMENT OF SURPRISE. I ACKNOWLEDGE AND AGREE THAT I HAVE BEEN INFORMED AND UNDERSTAND THAT MY APPEARANCE, DEPICTION AND/OR PORTRAYAL IN THE PROGRAM MAY BE DISPARAGING, DEFAMATORY, EMBARASSING OR OF AN OTHERWISE UNFAVORABLE NATURE WHICH MAY EXPOSE ME TO PUBLIC RIDICULE, HUMILIATION, OR CONDEMNATION AND, BEING SO INFORMED, I VOLUNTARILY AGREE TO APPEAR IN THE PROGRAM. I HEREBY RELEASE AND FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS AND CAUSES OF ACTION OF EVERY KIND AND NATURE, WHICH I MAY NOW HAVE OR MAY HEREAFTER ACQUIRE, ARISING OUT OF OR IN CONNECTION WITH MY APPEARANCE AND PARTICIPATION IN THE PROGRAM, INCLUDING WITHOUT LIMITATION, ANY CLAIMS, DEMANDS AND CAUSES OF ACTION FOR PERSONAL INJURY, INVASION OF PRIVACY, FALSE LIGHT PRIVACY OR VIOLATION OF THE RIGHT OF PUBLICITY, DEFAMATION, INFLICTION OF EMOTIONAL DISTRESS AND ANY OTHER TORT IN CONNECTION THEREWITH AND ANY COSTS AND EXPENSES (INCLUDING, WITHOUT LIMITATION, ATTORNEYS’ FEES, COURT COSTS, SETTLEMENT AND DISBURSEMENTS). 3. Use of Rights/No Revocation: I understand that AND is not obligated to use any of the Rights and Materials granted herein. I know AND will incur expenses in reliance on this Agreement, so I will not revoke it. 4. Entire Release: In agreeing to this Release, I have not relied on any representations or other statements that are not contained in this Release. No promises have been made to me other than as set forth in this Agreement. I understand and agree that no oral agreements are binding on Producer unless and until reduced to writing and signed by a duly authorized representative or officers of Producer. 5. Confidentiality: I acknowledge that in the course of my participation in the Program, I may gain access to confidential information, trade secrets, records, data, and other information (hereinafter collectively the “Information”) relating to the Program (including, without limitation, the identities of the participants and/or the outcome or content of any episode). I understand and agree that all such Information is and shall remain the property of Producer and/or its related or affiliated entities. I further agree that unless and until Producer discloses such Information to the general public, I shall not, without the prior written consent of Producer, disclose, or cause to be disclosed, any such Information to any third party or entity, for any reason or purpose whatsoever. I understand and acknowledge that I shall be held fully responsible for all costs and damages incurred by Producer which result from my breach of my confidentiality obligations, and that such costs may include the costs of production. 6. Other: Producer shall exclusively own the copyright in and to the Rights and Materials and any use and/or recordings made utilizing the Rights and Materials and Producer has complete and sole discretion as to their use. I represent and warrant that I have the full right, power and authority to grant the rights herein granted. Under penalties of perjury I certify that the information, materials and representations given or made by me which are contained on this form are true and correct. This Release shall be performed at least in part in California whose law shall govern and whose courts located in Los Angeles, California shall have exclusive jurisdiction over any dispute relating to this Release. In any such dispute, I hereby waive all rights to claim punitive, incidental and consequential damages. 7. I understand that it is a Federal offense and therefore I agree not to give anyone associated in any manner with the Program anything of value for arranging my appearance in the Program, or to accept or agree to accept anything of value to promote any product, service or venture in said Program, or to use any material containing such a promotion where I know the preparer of the material received consideration for its inclusion. I HAVE BEEN GIVEN AMPLE OPPORTUNITY TO READ, AND I HAVE CAREFULLY READ, THIS ENTIRE AUTHORIZATION AND RELEASE. I FULLY UNDERSTAND THE CONTENTS OF THIS AUTHORIZATION AND RELEASE, I AM OF SOUND MIND AND I INTEND TO BE LEGALLY BOUND BY THIS AUTHORIZATION AND RELEASE. I AM AWARE THAT THIS AUTHORIZATION AND RELEASE IS, AMONG OTHER THINGS, A RELEASE OF LIABILITY FOR FUTURE INJURIES AND A CONTRACT BETWEEN MYSELF AND AFN AND THAT I AM SIGNING THIS AUTHORIZATION AND RELEASE OF MY OWN FREE WILL. THE PROVISIONS HEREOF SHALL BE BINDING UPON ME AND MY HEIRS, EXECUTORS, ADMINISTRATORS AND SUCCESSORS.
